Can NC Leave Contributory Negligence Behind?

On Wednesday Evening, May 13, 2009, the North Carolina House of Representatives passed HB 813, which would replace our current contributory negligence system with a comparative fault model.  This should be a welcome change for accident victims in the state.

North Carolina is currently one of fewer than a half dozen jurisdictions clinging to a contrib system.  It’s time for us to move ahead.  I am cautiously optimistic we can finally establish a more rational system that can help reduce liability insurance denials in car accident claims.
