What is Workers' Compensation? Do I Need an Attorney?
"Workers' Compensation" refers to a legal system that protects the rights of workers who become injured while on the job. Each state in the U.S. has its own set of workers' compensation laws detailing the specific benefits to which an injured person may be entitled. This set of laws details the procedures a worker must follow in order to obtain "worker's comp" benefits.
These laws vary from state to state. There are also laws providing for federal employees as well as workers in specific types of industries that cross state boundaries, such as railroad workers, shipping industry workers, and other transportation and industry workers. A workers' compensation lawyer is trained to navigate these complex legal systems on behalf of injured workers.

Although there are some exceptions, such as for smaller businesses and farms, most North Carolina employers with 3 or more employees are required to provide workers' compensation insurance coverage for its employees. Workers' compensation insurance can provide benefits in the form of monetary compensation for certain job-related injuries or occupational diseases suffered by persons injured on the job in North Carolina.
It is important to note that workers' compensation is considered an exclusive remedy under North Carolina law. For this reason, other than a few rare exceptions, the employee is not allowed to sue the employer, is not entitled to payment for pain and suffering, and must pursue the claim with the employer's workers' compensation insurance carrier.
Workers' compensation claims, and the work of a workers' compensation lawyer, are closely regulated by the State. The North Carolina Industrial Commission is the legal body which administers the North Carolina Workers' Compensation Act.
