$62,000 Cy Pres Award Goes to North Carolina Justice Center Following Successful FDCPA Settlement by Attorneys at James Scott Farrin and Maginnis Law1
February 13th, 2020: The North Carolina Justice Center (NCJC) will receive $62,000 in funds that remain from a recent class action settlement related to alleged violations of the Fair Debt Collection Practices Act. Last year, attorneys at James Scott Farrin and Maginnis Law supervised two rounds of distribution to Class members after settling the case, but about $62,000 remained as a result of Class members not cashing the checks sent to them. Under the legal doctrine “cy pres,” a medieval French phrase meaning “as near as possible,” such a remainder can be directed to an organization that furthers a purpose similar to the purpose of that class action. The NCJC will use the ‘cy pres’ award to fund legal representation of indigent debtors in connection with bankruptcy and/or actions related to collections, and for other purposes that are related to the litigation brought by the Law Offices of James Scott Farrin and Maginnis Law. *Each case is unique and must be evaluated on its own merits.
