Jayla’s Story: Injustice, Hope & Recovery

Child hit by car in Warren County remains in coma at Duke: it’s a gut-wrenching headline to read, especially as a parent. We try to keep our children out of harm’s way, but we never expect the unthinkable to happen to our own children…until it does.

The headline above involved our young client and her family. Jayla Owens was just nine years old and in fourth grade when she was struck by a car and suffered severe and traumatic injuries. In the blink of an eye, she was fighting for her young life. This is Jayla’s story.

They Were Told to Prepare for the Worst.

On November 13, 2014, Jayla got off the school bus, allowed the school bus to continue on, looked both ways, and then crossed the street to check their mailbox.

Latrenta, Jayla’s mother, was inside the house. It seemed like a normal evening of homework, dinner, and bedtime.

Then, every parent’s nightmare happened – a car crashed into Jayla at full speed.

Three witnesses saw the car driving really fast and noted that it didn’t slow down before impact. The driver was on the phone before (and after!) hitting Jayla.

In the police report, the defendant stated that she was swerving to try to avoid Jayla, but she still ended up hitting the child. The witnesses also stated that the driver got out of her car still on the phone, crossed the street, and waited under a tree until first responders arrived.

Meanwhile, Jayla coded. Witnesses performed CPR until first responders arrived and revived her. Jayla was then airlifted to Duke University Hospital, and she coded again while in transit. She was revived a second time, and upon arriving at the hospital, she was put on life support with a severe brain injury.

Latrenta was told to prepare for the worst. The doctors told her they weren’t sure that her daughter  would ever be able to walk or speak again because her injuries were so severe. There were no assurances that she would even survive the night.

Help Was on the Way.

“I was terrified. I didn’t know what to do. We didn’t have insurance. How was I going to pay these bills? Her doctor’s bills were in the millions,” Latrenta said.

Then our legal team took charge.

They advocated tirelessly for Jayla in depositions, mediations, and negotiations with the insurance company. The first offer received was a low-ball offer, a tactic some insurance companies can employ to try to avoid paying full liability.

19X More for Diminished Value After We Got Involved1

Yazan H. was rear-ended by a drunk driver sustaining injuries as well as significant damage to his car. His injuries and treating for them were enough to deal with. But adding insult to injury? His car was brand new – a Kia Optima that was fresh off the showroom floor at the time of the accident.

Even more insulting, the insurance company offered him only $500!

(Truth is indeed stranger than fiction.)

Taking on the Insurance Company Was “a Horrible Idea”

Yazan recalled, “It was my first accident. I thought I could take on the big bad insurance company by myself. That was a horrible idea.”

Yazan found himself in a pickle. Here he was, injured, could not drive his new car because it was wrecked, and was forced to consider a take-it-or-leave-it $500 insurance offer that would not cover a fraction of what he needed for medical expenses and car repairs. To boot, the insurance company kept delaying his case.

Insurance Won’t Mention Diminished Value

Yazan was meeting roadblocks, it seemed, at every turn. After all, he was simply driving home one afternoon and obeying traffic laws when a drunk driver rammed into him. He knew that his car’s resale value would drop significantly as a result of the accident, and he wanted to make sure he was compensated for the difference in what his car would have resold for before the accident and after. Whatever that amount was, he knew it was significantly more than $500. This difference in value is called diminished value. What many people do not know is that some insurance companies, as a rule, will not tell you that they owe you diminished value.

How Our Firm Helped Someone Injured on the Job1

William H.’s life changed dramatically one afternoon when he was delivering roof trusses to a job site. In the process of unloading the truck, some of the heavy wooden trusses fell off the truck, pinning him down and breaking his back in three places.

For hours he felt excruciating pain throughout his body, and complete numbness in his leg. An EMS worker told William he was lucky — a few inches higher and he’d be a paraplegic, a few inches lower and he would have died. He also lost three pints of blood.

Driving to work one sunny Friday morning, Wanda stopped at a red light. Suddenly, her car was hit from behind with a force so great it was thrown 100 feet forward — knocking her unconscious.

How Our Firm Assisted a Client After a Work Injury1

Tyrone S. was a correctional officer working for the state. There was a scuffle with one of the inmates and Tyrone fell. Throwing his arm out to break the fall, Tyrone shattered his wrist and tore his rotator cuff.

To date, doctors have put a plate in his wrist, and he’s had four operations on his wrist and one on his shoulder.

Living the Dream Before “All of This Happened”1

Imagine you’re working in your dream job, things are going well for you and your family. You’re healthy and physically fit. Life is good.

And then one day, one moment, through no fault of your own, your world implodes. A car accident. A diagnosis. All outside your control.

Such was the case for Tony, who by simply routinely driving home from work, was at the wrong place at the wrong time, and thrust into a terrible situation. A situation that left him with a debilitating medical condition and little or no means of generating or receiving income.

Life spiraled downhill quickly.

Here is his story. It’s an all too familiar case of one moment, one day changing the course of someone’s life.

“Something Said ‘Check Your Six”’

Tony was gainfully employed in a job he loved and living the dream before “all of this happened.” On his way home from work he was rear-ended by another vehicle that was going approximately 70 mph. He recounted the incident:

“I was on the I-77 when I got rear-ended at 70 mph, and I was in stop and go traffic. We were just stopped and something said ‘check your six!’ So I look behind me and I see this guy not looking where he was going, so I tried to get out of the way, but he caught up and he hit me hard. My rear windshield came out in one piece. That’s how hard he hit me.”

The severe impact resulted in multiple bodily injuries, which included a severe concussion and injuries to the cervical spine. The injuries have left him with headaches so intense that he cries at times because his pain is so severe. The pain wakes him up at night and he often can’t go back to sleep. He vomits three to four times per week. And he has photosensitivity so severe he won’t go outside on a sunny day, even to his mailbox. His pain is so intense that he has minimal appetite, and when he does have an appetite, he is often unable to keep food down.

“For a year and a half I couldn’t keep food down on a regular basis. I went down from 155 lbs. to 123, and I’m 6’2!” he said.

Before the accident, Tony suggested he was very fit – all muscle, “155 was my fighting weight – all muscle. I had pecs, I had a six pack, nice biceps. That all went away to 123 lbs.”

Tony was essentially wasting away and extremely weak from lack of proper nutrition, yet could not eat due to a constant state of nausea.

Clearly Disabled, Twice Denied

Despite these circumstances his Social Security Disability case was denied. Twice! In his testimony at hearing, Tony noted that he lost everything as a result of an accident that was not his fault.

Things were indeed very different before the accident.

Tony enjoyed his job – and anything physical. He worked as a high-tech technician, where he actually looked forward to getting up in the mornings to go to work and working 10 hours a day. Before that, he was a motorcycle and auto mechanic, which he says was a physically demanding job. He enjoyed physical fitness and was into muscle building – he even enjoyed muscle cars, and is the proud owner of a 1971 Plymouth Roadrunner he had been restoring to its original ‘curious yellow’ color – a special color made for that model and year only.

“I was in a Mopar magazine …three times,” he recalled. (Mopar is short for motor parts, and mopar magazines are for high-performance muscle car enthusiasts.) “Mopar or no car – that’s all we wanted to drive,” he kidded.

Frankly, Tony used to love driving. “I drove 250 miles a week,” he said.

Not anymore. This muscle car (and motorcycle) enthusiast has been so traumatized by the car wreck, and so affected by his current photosensitivity, he only drives “to the store and back.”

He also used to enjoy working outside on his one-acre property, tending to his yard, shrubbery, and foliage. Yet due to his photosensitivity, that enjoyment has been stolen from him.

What does he do with his time now that he is no longer able to drive, go outside for long periods of time, and must deal with the constant headaches which interrupt sleeping and eating?

“I’m a couch potato,” he said half-jokingly.

“They’re Going to Take Care of You, Man”

When Rick Fleming and the Social Security Disability team learned that Tony – clearly disabled – had been denied twice, they were relentless. Attorney Fleming was eventually able to persuade the Social Security Disability administration to find Tony disabled and award him benefits.*

Tony received back-due disability benefits and became immediately eligible for Medicare. These benefits were earned over a long and productive working life that was cut short by no fault of his own.

During the long and arduous process, Tony was more than pleased with the consistent and open line of communication with Attorney Fleming and his team, “Some of my lawyers I’ve had with other firms, I’ll call them and call them and call them, and they never get back to me,” he acknowledged.

How Our Firm Helped a Client Who Was Rear-Ended1

Ironically, Salima H. was going to pick her cousin up from the hospital when the car she was riding in was rear-ended at a red light.

Concerned about her mother — the driver — Salima didn’t seek medical attention for her painful shoulder until the next day, when she woke up and found she was unable to move her arm. She took a sick day from her job as a nursing assistant and returned to the emergency room. They took x-rays and told her to see an orthopedic doctor in the next day or so.

“When I went to see the orthopedic doctor, he let me know I had some damage to my rotator cuff and even when it started to feel better it was always going to have problems,” she said.

The doctor scheduled her for several weeks of physical therapy and she had to miss about three weeks of work. The bills started to add up.

“The therapies, the physical therapies, the chiropractor, things like that, and the time off from work. We (my mother and me) realized that there were a lot of bills racking up and we really couldn’t just pay out of our pockets. We figured the best thing was just to seek some type of (legal) counseling,” Salima said.

When Jack M. felt an insurance company was pushing him to settle his workers’ compensation case before he was finished with treatment for a broken neck, he knew what he needed.

Ralph M. had endured serious injuries throughout his adult life. From accidents that caused his ankles to freeze up without warning, to third-degree burns, internal injuries and trouble regulating temperatures resulting from two different vehicle accidents — one involving a car accident and one a motorcycle accident.

Most recently, he was walking down the stairs at his Greenville, NC job when his ankle locked up, causing him to tumble down the stairs backwards.
